Jeff who is regular at WIPO judgments have got hundreds of famous peoples’ name registered and then he redirects them to his Celebrity1000.com website. Jeff is undoubtly the most well known domain name registrant.
This case once again highlights the flaws in UDRP (Uniform Domain Resolution Policy) model. Tom Cruise’s lawyer raised three points that made the authority to make decision in his favor. First of all the actor has common law trademark and service mark rights in the term Tom Cruise. Jeff was racking loads of cash from the domain via third party ads on his website Celebrity1000. Above all the visitors were likely to be confused as they may think that TomCuise.com was affiliated personally with the website.
